A powerful Duke (who is a recurring villain- planning to take the throne, etc. Maybe the PCs will find evidence here) has forced a merchant to betrothe his daughter to him for an unsettled debt. The Merchant hires the PCs to break into the Duke’s chateau, "kidnap" her, and deliver her to a boat bound for the Caribbean (his brother has a plantation there). The Duke keeps mademoiselle under lock and key (with plenty of guards) while he is away in Paris. As a major complication, the Duke returns while the PCs are storming the chateau- and he is the deadliest swordsman in the land!

A local preacher is corrupt & lecherous. When girls refuse his advances, he accuses them of witchcraft.

The crown has received reports of a "monster" devouring girls and sends the PCs to investigate. It is a "hell hound" under the command of a coven of warlocks.

A seaside town has been having a problem of its children disappearing. A young gypsy woman was going to be burnt as a witch by the Inquisition, accusing her of charming the children and luring them to a watery grave. The PCs stop the burning. Investigation finds that it is a cult who is behind it that the children are to be sacrificed in a seaside cave at midnight on friday the 13th. The PCs arrive in time to stop it- but not before something horrible is summoned.

A shopkeeper friend of the PCs- has had a gang come in and demand protection money- and the Alcalde demands his taxes be paid! If the taxes are not paid, the man will lose his shop! Of course it turns out that the criminals are in the employ of the Alcalde himself! But before the heroes can find out- they die in the dungeon (they kept their silence because the Alcalde promised he’d release them if they got caught). There is something about that Merchant’s shop that the Alcalde wants. bad enough to kill for.

However, some research shows that people often try marijuana before trying other substances. 10 We also know from animal studies that rats given repeated doses of THC show heightened behavioral responses and altered brain activation not only when further exposed to THC, but also when exposed to other drugs such as morphine. 11 Researchers are now looking at the possibility that exposure to marijuana as a teen can cause changes in the brain that make a person more likely to get addicted to marijuana or other drugs, such as alcohol, opioids, or cocaine.

It is important to point out, however, that research has not fully explained any of these observations, which are complex and likely to involve a combination of biological, social, and psychological factors.

Does smoking marijuana cause lung cancer?

Studies have not found an increased risk of lung cancer in marijuana smokers compared with nonsmokers. However, marijuana smoke does irritate the lungs and increases the likelihood of other lung and breathing problems. 12,13 Moreover, many people who smoke marijuana also smoke cigarettes, which do cause cancer, and research suggests that quitting tobacco can be harder if the person uses marijuana.

Can marijuana produce withdrawal symptoms when someone quits?

Yes. Many people who use the drug long-term and then stop have symptoms that are similar to those of nicotine withdrawal—irritability, sleep problems, anxiety, decreased appetite and various forms of physical discomfort—which may prompt relapse (a return to drug use). Withdrawal symptoms are generally mild and peak a few days after use has stopped. They gradually disappear within about 2 weeks. 14,15 While these symptoms do not pose an immediate threat to health, they can make it hard for someone to stop using the drug. Synthetic cannabinoids, which are sometimes also called K2 or Spice, consist of many human-made mind-altering chemicals that are either sprayed on dried, shredded plant material to be smoked, or sold as liquids to be inhaled in e-vaporizers. These chemicals are called cannabinoids because they have chemicals that act on the same brain cell receptors as THC, but are often much more powerful and unpredictable. Because of this similarity, synthetic cannabinoids are sometimes misleadingly called “synthetic marijuana” (or “fake weed”), and are often labeled “not fit for human consumption.” Many are now illegal, but their manufacturers are constantly creating new chemical compounds to sidestep legal restrictions. Their effects, like the ingredients, often vary, but emergency rooms report large numbers of young people appearing with rapid heart rates, vomiting, and negative mental responses including hallucinations after using these substances. Some states are reporting an increased number of overdose cases involving synthetic cannabinoid products where users are experiencing severe bleeding, likely due to product contamination.

Are there treatments for people addicted to marijuana?

Behavioral therapies are available and are similar to those used for treating other drug or alcohol addictions. These include motivational enhancement therapies to develop people’s own motivation to stay in treatment; cognitive behavioral therapies to teach strategies for avoiding drug use and its triggers (and for effectively managing stress); and motivational incentives, which provide vouchers or small cash rewards for showing up for treatment and staying drug free.

There are currently no medications approved by the U.S. Food and Drug Administration (FDA) for treating marijuana addiction, although promising research is under way to find medications to treat withdrawal symptoms and ease craving and other effects of marijuana.

What are other risks related to marijuana that my child should know?

Many parents and teens may not have thought about some of these risks:

  • As with many misused drugs, marijuana use interferes with judgment, which can lead to risky behaviors. For example, someone using marijuana might drive under the influence or ride with someone else who is intoxicated and get into a car crash, or might engage in risky sexual behavior and contract a sexually transmitted infection.
  • Regular marijuana use has been linked with increased risk for several mental problems, including depression, anxiety, suicidal thoughts, personality disturbances, and psychosis. Whether or not marijuana causes these problems, or is a response to them, is still unknown. More research is needed to confirm and better understand these links.
  • Research suggests that marijuana use during pregnancy may be linked to future developmental and hyperactivity disorders. 16 –19 However, the fact that pregnant women who use marijuana are also more likely to smoke cigarettes or drink alcohol makes it difficult to determine exactly how much of these effects are due to marijuana. In addition, some research suggests that after pregnancy, THC passes into the breast milk of nursing mothers in moderate amounts. 20 More research is needed to learn how this affects the baby’s developing brain. The American College of Obstetricians and Gynecologists recommends against using marijuana during pregnancy.

Is marijuana medicine?

Research shows that some chemicals in marijuana, THC as well as cannabidiol (CBD), could have medical uses. The FDA has approved some THC-based medications to treat nausea in patients undergoing chemotherapy and to help patients with AIDS gain an appetite. However, these medications are not smoked. The FDA has also approved a CBD oil-based medication to treat rare and severe forms of epilepsy. Additional clinical trials are being conducted to develop medications that contain THC and/or CBD for pain relief and seizure disorders.

How can I tell if my child has been using marijuana?

Parents should be aware of changes in their child’s behavior, such as not brushing hair or teeth, skipping showers, changes in mood, and challenging relationships with family members, and a change in friends. In addition, changes in grades, skipping classes or missing school, loss of interest in sports or other favorite activities, changes in eating or sleeping habits, and getting in trouble in school or with law enforcement could all be related to drug use—or may indicate other problems. If your child is using marijuana, he or she might:

  • seem unusually giggly and/or uncoordinated
  • have very red, bloodshot eyes or use eye drops often

The Smell of Grapes is here. This strain was a pleasure to work with from start to finish. She displayed vigorous growth in veg, and responded very well to multiple topping sessions. All tops transformed into dominant colas after about 10 days of stretch when switched to flower. She took all the veg nutes I could throw at her, following the REMO nutrient regiment. Flowering set in quickly and top bud sites were clearly visible by the end of week 1. Crystals started to develop by the middle of week 3. I harvested at day 56 and am overly pleased with the end result. Sticky frost covered buds that jam up my hand grinder. A very heavy stone that leaves you wanting a weed nap about 2 hours later. I wouldn’t recommend this strain if you are trying to be productive.

Tastes of subtle fruit with some spice. Smells similar, with the fruity notes really coming through with curling. Thick lung fulls of smoke on the exhale. Very satisfying.

When is it legal to possess marijuana?

The proposition becomes official when the election results are canvassed Nov. 30. At that point adults 21 and older can possess up to an ounce of marijuana, with no more than five grams in a concentrated form.

When is it legal to grow marijuana?

Like the possession rules, growing is allowed after the Nov. 30 canvass. Adults can grow six plants at home or no more than 12 plants in a house with more than one adult.

When can I buy marijuana?

The proposition requires the Department of Health Services to accept applications for medical dispensaries beginning in January, and to issue those licenses to qualified medical dispensaries within 60 days.

This means March is the earliest that people without medical-marijuana cards can buy marijuana at recreational retail locations. It’s possible the kick off will take longer, but dispensary operators are hoping to be able to offer recreational sales by April 20, 2021, or 420 as the cannabis holiday is called.

The measure states that if DHS doesn’t issue recreational licenses by April 5, medical dispensaries in good standing can begin offering sales to adults until the department issues licenses.

When can I get my felony marijuana conviction erased?

The measure states that starting July 12, people who were arrested, charged with, adjudicated or convicted, or sentenced for possessing two and a half ounces or less of marijuana, not more than 12.5 grams of concentrate, or having six marijuana plants, or marijuana paraphernalia, can petition to have the record expunged.

Phoenix defense attorney Thomas Dean estimates hundreds of thousands of people could petition for their records to be cleared, based on data that shows more than 10,000 people a year are arrested in Arizona for marijuana possession.

Most of those people are directed to costly drug treatment programs, and the record can prevent them from getting hired at a variety of jobs.

How many dispensaries will there be?

Arizona has about 120 operating medical dispensaries today, and they will be the first to be allowed to get licenses for adult sales to anyone over 21. There are about nine or 10 licenses in Arizona that are not yet being used at a dispensary, and eventually those are likely to open and sell medical and recreational marijuana.

The measure also allows DHS to issue licenses to counties where there are fewer than two dispensaries today. And finally, there are 26 “social equity” licenses to be issued (more on this below), which should bring the total number of dispensaries in the state to about 160.

What will the tax be and how much will it bring to the state?

The measure calls for an excise tax of 16% on recreational marijuana, on top of regular sales taxes, which vary by jurisdiction. Budget officials at the state Legislature expect the measure to bring in about $254 million from the combined taxes. Initiative backers have estimated a higher figure of about $300 million annually.

Where will all that money go and why won’t it go to K-12 education?

The money is distributed several ways, first paying for the additional services needed from DHS to administer the program and to law enforcement. The remaining funds go mostly to community colleges.

Initiative backers said the additional tax revenue could make a difference in the community college system, but would not be sufficient to address needs in K-12 schools, and they didn’t want to make what would have amounted to a token contribution to grade schools.

What is a ‘social equity’ license and who will get one?

DHS has the task of defining who can apply for the 26 social equity licenses available through the measure. The proposition only states that the licenses will be issued to “individuals from communities disproportionately impacted by the enforcement of previous marijuana laws.”

DHS has six months from the time it issues final rules on the program to issue the social equity licenses.

What can the dispensaries sell?

It depends. Dispensaries can continue to offer much of the same marijuana flower, concentrates, edibles and other product as they do for the medical program, but there are some limits on the adult-use sales that the medical sales don’t have.

The most significant is potency of edibles, which are limited to 10 mg of tetrahydrocannabinol (THC) per serving and 100 mg per package. Some products available now for medical patients are far stronger than this, and will remain available for sale to medical patients only.

The adult-use rules also prohibit any edibles from being shaped like a “human, animal, insect, fruit, toy or cartoon,” which is not a restriction on medical edibles today.

On a similar theme, dispensaries can’t sell products with names that resemble or imitate products marketed to children.

Vape pens and other forms of concentrated marijuana that are smoked will be available, though.

Is it legal to drive under the influence of marijuana?

Proposition 207 says that “driving, flying or boating while impaired to the slightest degree by marijuana remains illegal.” But it also says that simply testing positive for marijuana metabolites does not mean a person is impaired.

Under current Arizona law, drivers can be convicted of driving under the influence if they simply have marijuana metabolites in their system, which can last for weeks, long after the actual “high” has passed.

Proposition 207 says that “a person with metabolites or components of marijuana in the person’s body is guilty . only if the person is also impaired to the slightest degree.”

The change will mean people who use marijuana can’t be charged with driving impaired days later unless law enforcement officers also show the person was impaired, for example, with a roadside test or observations of erratic or inattentive driving.

Can I use marijuana at work?

Probably not. The measure states that it “does not restrict the rights of employers to maintain a drug-and-alcohol-fee workplace or affect the ability of employers to have workplace policies restricting the use of marijuana by employees or prospective employees.” So employers can prohibit marijuana use on the job and continue to test potential hires for usage.

“Under 207, employers can discriminate however they want,” said Dean, the attorney.

He said that employers can require workers to take a urinalysis that can detect inactive metabolites that may signal marijuana use a month after the fact.

“I don’t think there’s anything you can do to stop that kind of adverse action against employees,” he said.

That is one reason some patients may choose to maintain their medical-marijuana cards, despite the fee to the state every two years and the cost of a doctor’s recommendation. Medical-marijuana patients do have some workplace protections.

“They cannot fire someone (with a medical card) for a positive test,” Dean said. “They can only take action against them if they are impaired at the workplace or are in possession of medical marijuana in the workplace.”

People v. Valentine (1988)

Michael Valentine appeals his jury-tried conviction of cultivating marijuana (Health & Saf. Code, § 11358) and possessing marijuana for sale (Health & Saf. Code, § 11359). Valentine contends (1) the court prejudicially erred in allowing evidence of intravenous drug use to show he was cultivating marijuana; (2) the evidence was insufficient to support his conviction; and (3) the court erred in imposing two restitution fines for a victimless crime. We agree the introduction of evidence Valentine was an intravenous drug user was improper and accordingly reverse on that ground.

Factual and Procedural Background

At about 7 a.m. on June 19, 1985, 18 sheriff’s deputies forcibly entered the house at 1425 East Alvarado in Fallbrook with a warrant to search the premises. Valentine and his girlfriend were asleep in the east bedroom and Alvin Jenkins was also in the house.

The officers searched the premises and found 90 marijuana plants, with an average height of 4 feet, growing about 20 yards from the house in a garden area behind a trailer. The garden was weeded and contained wet soil and was surrounded by bamboo and other trees.

In the north bedroom, the officers found loose marijuana seeds on a wall unit shelf and on a night stand. They also found two magazines dated October 1983 and August 1984 addressed to Valentine at 1425 East Alvarado and a “Sweepstakes Notification” addressed to Valentine. A hypodermic syringe and needle were also found in that bedroom.

In the east bedroom, the officers seized a hypodermic syringe, a wooden plaque of a laminated marijuana leaf, an envelope addressed to Valentine at 1425 East Alvarado, and Valentine’s driver’s license with the address 1425 [207 Cal. App. 3d 700] East Alvarado. The deputies also seized a marijuana pipe, and a hand-held scale.

Two prescription bottles filled with marijuana seeds, one of which contained Valentine’s name and the date 1980, were found in the living room. The officers also found in the living room two books entitled “Marijuana Grower’s Guide” and “Magical Mushroom Handbook,” two hypodermic syringes, two marijuana pipes and an ounce-quantity scale.

Valentine was charged with cultivating marijuana, possessing marijuana and possessing a hypodermic needle and syringe. After trial, the jury failed to reach a verdict and the court declared a mistrial. Valentine then successfully moved to dismiss the charge of possessing a hypodermic needle and syringe.

After a second trial on the remaining two counts of cultivating marijuana and possessing marijuana for sale, the jury convicted Valentine on both counts. At sentencing, the court granted probation conditioned on Valentine serving 180 days in jail. The court also imposed (1) a fine of $500 including penalty assessments; (2) a fine of $500 payable to the state restitution fund; and (3) a restitution fine of $500 under Government Code section 13967, stayed under Penal Code section 1202.4, subdivision (b), the stay to become permanent upon successful completion of probation.

[1a] Valentine contends the court erred in allowing the People to introduce evidence of intravenous drug use to show he was cultivating marijuana.

This cause had been previously tried and the jury deliberations resulted in a mistrial as to the then three counts, count three being a charge of possession of needles and syringes. In the second trial, the needles and syringes were again introduced in evidence. At the beginning of the second trial, Valentine, after dismissal of the third count, sought by an in limine motion to have the court rule the needles and syringes evidence was irrelevant, bgcause there was no foundation and the evidence could not be in any way logically related to the charges being tried, to wit, cultivating marijuana for sale. It was further argued that such evidence would be highly prejudicial under Evidence Code section 352. The court ruled the needles and syringes admissible “to establish the fact that the marijuana plants would be owned by the defendant.” The court reasoned in response to further objections that the evidence would be allowed because it was reasonable to infer that a person who injects narcotics also grows marijuana. The court in addition to [207 Cal. App. 3d 701] admitting the evidence of the needles and syringes allowed a deputy sheriff to testify for the People for purposes of impeachment that in his opinion Valentine had injected needles or had his arm punctured with needles in the past.

Valentine did not raise the issue of use of intravenous or narcotic drugs; rather the People did in their case-in-chief by introducing evidence of the needles and syringes on direct examination.

Barry Ellis Sweeney testified on direct examination: “Q. Detective Sweeney, based on your training and experience working as a narcotics officer, have you encountered hypodermic syringes before?

“Q. How are they used in connection with the use of narcotics, controlled substances?

“A. They’re used to inject.

“Q. What do you mean, ‘They’re used to inject’?

“A. The controlled substances.

“Q. And have you previously been involved in searches of residences where marijuana was found where hypodermic syringes were also found?

“Q. Would that be on more than one occasion?

On cross-examination, Valentine was asked; “Now these hypodermic needles that were in the house, isn’t it true that you were using those to inject yourself with narcotics? . You were using those to inject yourself, correct?” Valentine responded he was not. The People contended because Valentine denied that in 1985 he had used needles and syringes to inject himself, they were entitled to impeach him with evidence showing he had. The court allowed the “impeaching” testimony of the deputy sheriff and former narcotics officer who examined Valentine’s arms and found needle tracks.

At first the court felt the testimony Valentine might be using hypodermic needles at the time of the trial would be remote to the issue of whether he was using them two years earlier in 1985, and that the prejudice would outweigh the probative value. However, the court reserved its ruling and ordered Valentine to be examined by the deputy. [207 Cal. App. 3d 702]

The prosecutor told the court he had found old track marks on Valentine’s arm. The court ruled it should be admitted on the ground “[i]t involves his credibility.” An Evidence Code section 352 objection was also raised by Valentine, but overruled. The court finally permitted Deputy Cross to testify over Valentine’s renewed objections. The court felt that Cross’s testimony was sufficiently probative with respect to the issue of credibility as to permit him to testify subject to a limiting instruction. Valentine then sought to introduce the dismissal of former count three but the court denied it.

[2] Evidence of a collateral independent crime is not admissible unless it tends directly to establish the crime charged by proving a material fact or intent, premeditation, guilty knowledge, malice or a common plan or scheme. (People v. Hill (1967) 66 Cal. 2d 536, 555 [58 Cal. Rptr. 340, 426 P.2d 908]; People v. Meacham (1984) 152 Cal. App. 3d 142, 156 [199 Cal. Rptr. 586]; Evid. Code, § 1101.)

Evidence Code section 1101 provides: “(a) Except as provided in this section and in sections 1102 and 1103, evidence of a person’s character or a trait of his or her character (whether in the form of an opinion, evidence of reputation, or evidence of specific instances of his or her conduct) is inadmissible when offered to prove his or her conduct on a specified occasion.

“(b) Nothing in this section prohibits the admission of evidence that a person committed a crime, civil wrong, or other act when relevant to prove some fact (such as motive, opportunity, intent, preparation, plan, knowledge, identity, absence of mistake or accident, or whether a defendant in a prosecution for an unlawful sexual act or attempted unlawful sexual act did not reasonably and in good faith believe that the victim consented) other than his or her disposition to commit such an act.” (Italics added.)

It was said in People v. Albertson (1944) 23 Cal. 2d 550, 578 [145 P.2d 7]: “(b) [C]ollateral offense cannot be put in evidence without proof that the accused was concerned in its commission; (c) there must be identity of person or crime, scienter, intent, system, or some integral parts of the exceptions established between the charge under trial and that sought to be introduced, that clearly connects the accused, showing that the person who committed the one crime must have committed the other.” (Italics added; see also People v. Poulin (1972) 27 Cal. App. 3d 54, 65 [103 Cal. Rptr. 623].)

The Supreme Court in People v. Thompson (1980) 27 Cal. 3d 303 [165 Cal. Rptr. 289, 611 P.2d 883], held, in ascertaining whether evidence of other crimes has a tendency to prove the material fact, the court must first determine whether or not the uncharged offense serves logically, naturally, [207 Cal. App. 3d 703] and by reasonable inference to establish that fact. In addition, “‘admission of other crimes evidence cannot be justified merely by asserting an admissible purpose'” in the abstract. The key question is “whether the particular evidence of defendant’s other offenses here offered is logically relevant to prove the defendant’s intent in this case.'” (Id. at p. 319, italics added.) Lastly, since “‘substantial prejudicial effect [is] inherent in [other crimes] evidence,’ uncharged offenses are admissible only if they have substantial probative value. If there is any doubt, the evidence should be excluded.” (Id. at p. 318.)

The test of admissibility is whether there is some clear connection between the collateral offense and the one charged so that it may logically be inferred if the defendant committed one offense he must be guilty of the other. (People v. Cramer (1967) 67 Cal. 2d 126, 129-130 [60 Cal. Rptr. 230, 429 P.2d 582].) [3] Thus, while courts have allowed evidence of narcotics addiction and financial condition to establish a motive for the possession of narcotics and their sale (see People v. Morales (1979) 88 Cal. App. 3d 259, 263-264 [151 Cal.Rptr. 610]), yet evidence of addiction alone without proof of the extent of it, its expense and frequency of use is not sufficiently relevant to establish motive. In People v. Reid (1982) 133 Cal. App. 3d 354 [184 Cal. Rptr. 186], the court said: “Appellant concedes that a defendant’s need for money may be relevant to show motive in a robbery case. Appellant also concedes if a defendant has a drug habit which requires expenditures beyond his means, then such evidence is logically relevant to prove motive under Evidence Code section 1101. (People v. Perez (1974) 42 Cal. App. 3d 760, 767-768 [117 Cal. Rptr. 195].)” (Id. at p. 362.)

However, the court concluded: “There is no doubt that in the instant case the drug evidence (appellant’s track marks and finding drug paraphernalia in his home), tended to establish appellant was a drug user. Appellant does not contest this claim. However, in order for the drug evidence to be admissible in this case, the prosecution must have established a reasonable basis for inferring the cost of appellant’s habit or use. There was no evidence as to what drugs appellant used, or how often. There was no evidence to indicate how fresh appellant’s track marks were. Absent that link, the second requirement of the test set forth in People v. Thompson, supra, 27 Cal. 3d 303, is not met. The fact that appellant used drugs, without more, does not have a tendency to prove a motive for robbery. The prosecution’s failure to estabnish these matters, coupled with the fact that other crimes evidence involving the use of narcotics presents a grave danger of improperly influencing the jury, establishes that the evidence should have been excluded. (Evid. Code, § 1101, subd. (a).)” (Italics added, 133 Cal.App.3d at p. 363.)

Finally, all doubts concerning the connection of the crime charged must be resolved in the accused’s favor. (People v. Sam (1969) 71 Cal. 2d 194, 203 [77 Cal. Rptr. 804, 454 P.2d 700].) [207 Cal. App. 3d 704]

[1b] Here, the People did not make even an attempt to explain why the proffered evidence would be relevant and admissible under Evidence Code section 1101, subdivision (b). There was no offer of proof to show motive, opportunity, intent, preparation, plan, knowledge, identity, absence of mistake or accident; rather the People offered the hypodermic needles and syringes on the theory that someone involved in one type of narcotics activity would also be involved in smoking marijuana. “They kind of run in the same crowds” said the prosecutor. This same argument was made by the prosecutor to the jury. Not only was the prosecutor allowed to argue in such fashion, but there was the testimony of the expert who told the jurors where hypodermic needles are found, so is marijuana. This was an invitation to specious reasoning and should be excluded from civil trials as well as criminal trials with greater force and reasoning.

The court expressed approval of the prosecutor’s reasoning when it said: “[T]he People are entitled to establish and to make the argument that the people may use controlled substances, and marijuana is a controlled substance. And it’s reasonable for them [the jury] to believe that if . Mr. Valentine was using hypodermic needles for the administration of controlled substances, that they can use that as a matter of circumstantial evidence to infer that he is the owner or person in control of the marijuana plants. That’s what they can do. That’s what I’m finding.”

The evidence was not admitted for one of the lawful exceptions under Evidence Code section 1101, subdivision (b) but rather for the purpose of establishing an inference of Valentine’s propensity or disposition to commit crimes in general and “drug crimes” in particular. This is an inadmissible purpose. (See People v. Alcala (1984) 36 Cal. 3d 604, 635 [205 Cal. Rptr. 775, 685 P.2d 1126]; People v. Andrews (1983) 149 Cal. App. 3d 358, 364 [196 Cal. Rptr. 796, 46 A.L.R.4th 1].)

[4] Valentine further contends improperly allowed cross-examination cannot lay a foundation for the introduction of inadmissible matters in rebuttal. In People v. Davis (1965) 233 Cal. App. 2d 156, 160 [43 Cal. Rptr. 357], the defendant denied on cross-examination that he was under the influence of narcotics at the time of his arrest. The charges were driving a getaway car and robbery. The People called the arresting officer as a rebuttal witness who testified over objection that in his opinion Davis had been under the influence of narcotics at the time of his arrest. The court gave a limiting instruction that the evidence was to be used only on the issue of credibility. However, the appellate court found the connection between use of narcotics and robbery was tenuous at best (id. at p. 161) and rejected the credibility rationale out of hand as the issue of narcotics usage had been [207 Cal. App. 3d 705] raised by the prosecution. (See also People v. Vanderburg (1960) 184 Cal. App. 2d 33, 40-42 [7 Cal. Rptr. 287].)

The issue of intraveneous drug use by Valentine was raised by the prosecutor. He did so by improperly introducing the needle and syringe and by asking Valentine on cross-examination whether he had ever used needles and syringes to inject narcotics. He then impeached him by the testimony of Deputy Cross that Valentine’s right arm had puncture marks.

Such evidence was improperly admitted in violation of Evidence Code sections 786 and 787, contrary to the mandates of Evidence Code section 1101. This impeachment was an improper rebuttal to a collateral matter improperly raised on cross-examination. Valentine objected to the introduction of the needles and syringes and track evidence under Evidence Code section 352. The trial court’s weighing of the probative value against the prejudice of introducing the needles was peremptory. “I think it’s probative, I don’t think it’s — I think it’s extremely probative. I won’t find that the prejudice if there is any is in any way outweighs the probative value with respect to the hypodermic needles.” This ruling was made at a time when the court had no evidence of the prejudicial effect of such evidence on Valentine.

The evidence of intraveneous drug usage was not only irrelevant to the crimes charged but was highly prejudicial to Valentine. The prosecutor admitted that he wished to introduce the track evidence to link Valentine to the needles and syringes rather than to the marijuana.

The court gave limiting jury instructions, CALJIC No. 2.09, and modified 2.50. Such limiting instructions do not confer on jurors an ability to weigh improperly admitted evidence of a collateral offense which has been introduced over objections. The limiting instructions in this case were in direct opposition to what the prosecutor told the jury: to consider the evidence of the needles and syringes as proof of Valentine’s (bad character?) commission of the crimes charged. The jury was told to consider the tracks evidence as proof that Valentine was a liar. Both the judge and the prosecutor repeatedly referred to the needles and syringes as having a direct bearing on Valentine’s propensity to engage in the growing and sale of marijuana. The court found the association a reasonable inference for the jury to make. In the same breath as the court told the jurors not to consider evidence of needles and syringes to prove Valentine a person of bad character or disposed to commit crimes, the court told them they could consider such evidence if it tended to show Valentine possessed or had knowledge of the marijuana plants. The track evidence was impermissibly introduced for the purpose of impeaching credibility. Although the jurors were instructed to [207 Cal. App. 3d 706] consider it for that purpose, the limiting instruction would not cure the error committed.

[1c] This case factually, by any stretch of the imagination, cannot be regarded an overwhelming case on behalf of the People. The two charges were previously tried together with the needles and syringes charge. In that case, the court declared a mistrial on all counts in view of an eight-to-one vote for acquittal on count one (cultivating marijuana), and ten-to-two vote for acquittal on count three(possessing needles and syringes) and an evenly divided jury on count two (possession for sale). The entire focus of Valentine’s trial from marijuana onto needles and syringes and tracks on his arms cannot be viewed other than highly prejudicial and warrants reversal.

In view of our decision to reverse and remand for a new trial, we do not examine the further claims of error.

Illegal Cannabis Farms Are Making the Climate Crisis Worse

Residents of Doncaster in South Yorkshire had wondered why their town had been experiencing random power outages over the last year. But then the answer came when police discovered a huge cannabis farm in an abandoned bingo hall on the outskirts of the town. Kitted out with high-tech equipment and 1,000 watt lamps, it contained over 2,000 plants worth more than £2 million and would have cost as much as £50,000 to install. 

The monster grow was typical of the UK’s blossoming £2.5 billion illegal cannabis industry. British growers produce hundreds of tonnes of black market weed each year to cater for the country’s estimated 2.6 million cannabis users, most of it grown inside buildings under high-powered lamps. Setting up behind closed doors in abandoned warehouses and repurposed homes – recent busts include old cinemas and suburban houses – helps keep a low profile from police and thieves. 

Due to its illegality, the hidden nature of the cannabis cultivation industry comes at huge cost. It has fuelled slave labour and escalating violence by the criminal gangs which run many of them. Yet one harm of this industry remains little-understood: its pernicious impact on the environment. 

Your Drug Habit Is Destroying the Planet

Cannabis grown indoors needs a narrow set of conditions if it is to produce multiple potent harvests a year. Most prominent are the intensely bright lamps, which run for at least 12 and up to 24 hours a day to mimic the sun. But there’s more: air conditioning keeps the room at a constant humidity and temperature of 25-30 degrees, large extractor fans ventilate the plants and carbon scrubbers pull tell-tale smells from the air. Sophisticated growers may even pump rooms with bottled CO2 to make the plants grow faster.

Cannabis farms are far from green. Many burn through up to 50 times more power per square metre than homes and offices. In 2012, UK weed growers stole £200 million worth of electricity. 

“It's an incredibly, unusually energy intensive activity,” said Dr Evan Mills, a Californian energy scientist who was one of the first to examine the environmental impact of indoor cannabis cultivation. 

In a landmark study in 2011 Mills estimated that each kilo of weed grown indoor in the U.S. takes 6,074 kilowatt-hours of electricity to produce. He worked out that at the time America’s largely indoor-grown cannabis industry was using one percent of all the electricity generated in America. 

In terms of carbon emissions emitted by electricity generation on the UK grid, every kilo of weed grown in indoor UK cannabis farms produces just over one tonne of carbon emissions, around the same as a return flight from London to New York. Producing just one joint’s worth of weed has the same carbon footprint as leaving an LED light bulb on day and night for 15 days. An operation the size of the Doncaster farm would be responsible for almost 5,000 tonnes of greenhouse gases per year. 

Estimates for the UK’s total illicit cannabis production range from between 255–735 tonnes annually. With most of this grown in professionally-run weed farms, this could mean as much as 950,000 tonnes of CO2-equivalent gases pouring into the atmosphere each year from British grow ops – the same as running nearly half a million cars for a year. 

The environmental impact doesn’t stop there.

“A lot of small scale growers are concerned about environmental issues and some of them will deliberately choose organic methods,” said Dr Gary Potter, a cannabis production expert at the University of Lancaster. “But if you’re a large-scale commercial grower, you’re using chemicals, whether that's fertilisers or insecticides or herbicides. The chemicals themselves are not very well regulated and labelling is poor. So even when people do care, they are not necessarily aware of the impact of some of the things that they’re using.”

Some of the most concerning chemicals are synthetic Plant Growth Regulators (PGRs), which are commonly used to increase bud size despite being banned from food crops. When ingested over a long period of time, these “plant steroids” can cause cancer, liver problems and infertility. 

Rat and insect poisons are widely used by growers to keep pests at bay, but can leach into the environment when waste materials from grow ops are dumped, harming wildlife and humans. Any residue from these chemicals left on weed may be consumed by users. A recent study recommended pesticide controls for weed “go beyond those of normal agriculture… as they may be inhaled at high temperatures or ingested”. 

People Are Getting Killed in Britain’s Cannabis Farm Wars

Unlike in the US, where weed farms have been blamed for drying up streams, water use is not so much of an issue in the UK’s rainy climate. Yet bizarrely, the plant itself causes air pollution. Cannabis leaves release toxic compounds called terpenes which can build up indoors if not properly filtered, causing potential harm to cannabis farm workers who are with plants in enclosed areas for long periods of time. In urban areas, these gases react with traffic fumes to form ozone, a gas which is useful in the stratosphere, but harmful when we breathe it in.

Britain’s illegal cannabis industry isn’t even the largest in Europe. Spain, the Netherlands, Albania and Italy are all major producers of black market weed, with Europe as a whole churning out 2,500 or so tonnes per year. Power outages caused by Dutch grow ops are common, where they use as much power as the entire city of Leeds. In Morocco, illegal plantations are causing widespread deforestation, soil erosion and water stress in the Rif region. 

None of this meshes well with the image of cannabis as a green, natural drug. Heavy electricity use is a relatively new phenomenon, born in the mid-2000s when super-strength skunk became popular and extremely profitable. As recently as 1997, 70 percent of British cannabis growers used only natural light and the majority of weed consumed here was grown outdoors in warmer countries. 

“With technical innovations like hydroponics and new strains of seeds, suddenly it became possible to make £10,000 or £20,000 from your spare room,” said Steve Rolles from drugs policy think tank Transform.

Now only a small proportion of the UK’s crop is grown outside and organised crime groups have taken a large share of the market. For Rolles, the environmental damage of nefarious indoor weed grows is an argument for legalisation and regulation. 

“Illegal producers do not bear the costs to the environment of what they’re doing, because there's no accountability or regulatory structures around them. They just make their money.

“Within a legal market, the electricity use can be dealt with by establishing controls on the amount of power that can be used per volume of cannabis production and mandating outdoor or greenhouse grows… It becomes just like growing tomatoes.” 

Until then, if you’re concerned about your own consumption there are steps you can take. “It is possible to get environmentally sustainable illegal cannabis in a way that it's not possible for cocaine,” said Rolles, “by either growing your own, or getting it from a small-scale grower or cooperative who could vouch for the provenance of a particular crop.”

Greenhouses, common in Britain’s burgeoning medical cannabis industry, use significantly less energy than fully-indoor production. Even better, when grown in the open air (or a back garden polytunnel), weed is considered eco-friendly for its ability to suck carbon from the air and store it in the soil. This is the ethos of the “guerilla growers” movement which plants in secret, open-air sites, or non-profit cannabis social clubs.

When you talk about cannabis, folks tend to assume you’re a stoner. Add in my fro, fondness for boho fashion, and love of essential oils, and it’s easy for people to assume I must be. Which considering my license as a dietitian and legal status of marijuana where I live, would be a violation of the law and my code of ethics.

Truth be told, aside from the time in elementary school when my older friend (who had much older friends) rolled sugar, pepper, and dried grass from her backyard in a sheet of loose leaf paper and offered it to me as a makeshift dooby, I’ve never been offered a smoke of anything, nor have I ever smoked anything. But just because I choose not to, doesn’t mean I’m completely against others choosing to.

There are medically legitimate reasons to take it. And it’s the most used recreational drug in the US. Nearly half of the US population has tried it at least once. With more and more states decriminalizing its use, medical marijuana going mainstream (heck, even Whoopi Goldberg has medical cannabis line of products for menstrual issues), and Well + Good dubbing cannabis as one of THE wellness trends to watch in 2017, I’m sure its use is only going to continue to increase.

Recreational marijuana’s THC levels are significantly higher than what you’ll find in medical varieties, giving them exaggerated psychoactive properties. Plus, if you purchase pot from any place other than a dispensary or store, you really can’t ensure purity. That’s because it’s pretty common for sellers to mix in additives. And those additives can have unpredictable and dangerous side effects.
